This case is before the Court on Defendant’s motion to dismiss the complaint filed by Ameristar Financial Servicing Company, LLC (“Ameristar”) on May 24, 2006, in its entirety for lack of subject matter jurisdiction. Plaintiff alleges that the Federal Deposit Insurance Corporation (“FDIC”) is responsible for breach of a contract Ameristar entered into with a then-newly established federal savings bank for which the FDIC was acting as conservator.
