This case comes to us on appeal (No. 93-1392) from, and on petition for writ of mandamus (93-1450) to, the United States District Court for the Eastern District of Pennsylvania. Defendant and petitioner, Osteopathic Medical Center of Philadelphia (“Osteopathic”), asks us to review an order of the district court granting plaintiff Patrick Carr’s (“Carr”) motion to dismiss Osteopathic’s co-defendant, American Red Cross (“Red Cross”), from Carr’s personal injury suit.
