*1119In an action for money had and received and to recover damages for breach of fiduciary duty, violation of General Business Law § 349, and unjust enrichment, the defendant appeals from an order of the Supreme Court, Nassau County (Woodard, J.), entered September 4, 2007, which denied its motion to dismiss the complaint pursuant to CPLR 3211 (a) (1) and (7) and granted the plaintiff’s cross motion for leave to amend the complaint to add a cause of action alleging fraud and a demand for punitive damages.
