ALDRICH, Chief Judge.
This appeal from the dismissal of a petition for a writ of habeas corpus raises the single question whether the petitioner was deprived of any constitutional rights when, after a guilty plea, the prosecutor reported to the sentencing judge in the absence of petitioner and his counsel a highly detrimental hearsay statement as to petitioner’s conduct. The district court, on the record of the state postconviction proceedings, dismissed the petition without an evidentiary hearing. See Townsend v.
