OPINION
By LAMNECK, J.
The plaintiff, who seeks to be divorced from the defendant on the grounds of extreme cruelty and gross neglect of duty, filed his petition therefor in this Court on January 28 1946.
*173The defendant in her answer contests the jurisdiction of the Court to entertain the petition on the ground that the plaintiff had not been a resident of this state for a period of one year immediately preceding the filing of the petition.
