Error from Allen District Court. Action to foreclose a mortgage. Trial by the court, at the November Term, 1885, and judgment for defendant Hottenstein. The plaintiff Northrup brings the case to this court. The material facts are stated in the opinion.

This was an action brought by L. L. Northrup, on September 13,1884, in the district court of Allen ■county, against Luther J. Keeney, Maria H. Keeney, The *264New England Mortgage Security Co., F. W. Dunton and Mary E. Hottenstein, to foreclose a mortgage executed to the plaintiff by Luther J. Keeney and his wife Maria H. Keeney for certain real estate situated in said county.
