The complainant was elected as a member of the county board of education, for a term of seven years, by the county court of Morgan County in 1927. In 1930 he was elected a member of the General Assembly • of Tennessee. Upon his qualification to the latter position, the county court of Morgan County assumed that he vacated his place on the hoard of education and proceeded to elect defendant to fill that vacancy.
