Plaintiff, assignee of Daniel J. Alpert, her brother, sued in assumpsit on an arbitration award dated January 31, 1931. The award grew out of Alpert’s disputed claim for legal services and expenses in representing defendant for several years in tax title litigation. Alpert and defendant agreed to submit their differences to arbitrators, and they awarded Mr. Alpert $10,000 ; he gave his written consent to accept tax titles and tax leases in lieu of the cash award, but, defendant never attempted to fulfill the obligation.
