Plaintiff, Herbert Eggert, brought this action in federal court based on diversity of citizenship among the parties, the amount in controversy exceeding $10,000, 28 U.S.C. § 1332, to recover the proceeds from the sale of his stamp collection by Bob Weisz Stamps, Inc. (Bob Weisz Stamps). Because Bob Weisz Stamps no longer exists, Eggert has sued defendants Robert Weisz, David Blair, and Mary Anne Foran personally, asserting that they are liable for their roles in the alleged conversion of the proceeds by Bob Weisz Stamps.
