*639In a proceeding pursuant to CPLR article 78, inter alia, to review a determination of the appellant dated April 22, 1999, terminating the employment of the petitioner Carol Lyons, the appeal is from a judgment of the Supreme Court, Rockland County (Bergerman, J.), dated August 7, 2002, which granted the petition.
Ordered that the judgment is reversed, on the law, with costs, the determination is confirmed, the petition is denied, and the proceeding is dismissed on the merits.
