—Appeal by the People from so much of an order of the Supreme Court, *494Queens County (Robinson, J.), dated November 19, 1992, as granted the branch of the defendant’s omnibus motion which was to dismiss Queens County Indictment No. 12138/92 on the ground that it is not supported by legally sufficient evidence.

Ordered that the order is reversed insofar as appealed from, on the law, the branch of the defendant’s omnibus motion which was to dismiss the indictment on the ground that it is not supported by legally sufficient evidence is denied, the indictment is reinstated, and the matter is…
