This is an action of tort to recover damages for injuries sustained by the plaintiff by the caving in of a sidewalk on Washington Street, a public way in the city of Boston, on the evening of December 2, 1927. Sufficient written notice of the time, place and cause of the accident to the plaintiff was seasonably received by the defendant. At the close of the evidence the trial judge allowed the defendant’s motion for a directed verdict.
