The plaintiff, who brought this action of tort under G. L. (Ter. Ed.) c. 84, §§ 1, 15, to recover for personal injuries resulting from an alleged defect in a public way, had a verdict in his favor. The case comes here on exceptions of the defendant to the denial of a motion for a directed verdict, to the refusal to grant certain requests for instructions, and to a portion of the charge.
