The material questions presented for consideration in this case have already been determined by the recent decision of the supreme court of the United States. It is unnecessary, therefore, to repeat at large the facts of the case; they are given in the report of the' decision in 18 Wall. [85 U. S.] 350. It will be sufficient to state here its general features.
