Plaintiff, John Junior Amsley, a Pennsylvania resident, brought this action against the West Virginia Racing Com*816mission (hereafter Commission) in the federal district court for the Northern District of West Virginia seeking declaratory and injunctive relief for alléged constitutional deprivations.
