Defendant, having been indicted for the crime of perjury in the first degree, has applied for an order dismissing the indictment, or, in the alternative, for permission to inspect the Grand Jury minutes upon which the indictment against him was found.

The indictment, returned on October 5, 1956, contains one count and charges that “ Defendant, on or about the 16th day of July, 1956, at Riverhead, Town of Riverhead, Suffolk County, New York, committed the crime of perjury in the first degree, contrary to Penal Law, Section 1620-a.” Annexed to the indictment is a statement made by the District…
