Plaintiffs Rex and Martha Thorn, Diesel Repower, and Thorn’s Diesel Service, Inc., bring this lawsuit against defendant American States Insurance Company, seeking damages for state-law claims of breach of contract and bad-faith refusal to investigate or provide defense costs and indemnity coverage. This cause is now before the court on the motion for summary judgment filed by American States, the cross-motion for summary judgment filed by the plaintiffs, and the motion to strike the affidavit of Ron Davenport filed by the plaintiffs.
