This action, brought by the Commissioner of the New York *190State Department of Environmental Conservation and the Commissioner of the Suffolk County Department of Health Services (plaintiffs) in September 1989, seeks injunctive relief, damages and penalties with respect to groundwater contamination in Suffolk County by the herbicide dimethyl tetrachloroterephthalate and/or its metabolites.
