This is a case which tests the requirement that there be “no genuine issue as to any material fact” in a successful motion for summary judgment, Fed.R.Civ.P. 56(c). Gregorio Lopez brought suit under 42 U.S.C. § 1983 claiming violation of his constitutional rights by three deputy sheriffs at the Bexar County jail, San Antonio; Texas. He sought a temporary restraining order, a preliminary injunction, and damages.
