Brooks pleaded not guilty to an accusation charging in one count that he “unlawfully did sell and barter for a valuable consideration, directly and indirectly, and keep on hand at his place of business, alcoholic, spirituous, malt, and intoxicat*4ing liquors, and other drinks, which, if drunk to excess, will produce intoxication.” He was convicted, his motion for new trial was overruled, and he excepted.
