The finding of fact which is the subject of the first assignment of error is not strictly in accordance with the evidence, but the element thereof against which the appellant complains *202was not material to the determination of the question in controversy. If the strip of ground in question was dedicated to public use by the deed under which appellant took title, it matters not whether the name of the grantor was Delano or Taylor.
