This is an action of ejectment for a small tract of land on Nittany Mountain, Centre County, valuable for park purposes because, of its extended view. The action was brought by the plaintiff pursuant to a rule entered under the provisions of the Act of April 16, 1903, P. L. 212, by the defendant in possession of the tract, requiring the plaintiff to bring an action of ejectment within sis months thereafter.

Both parties claim from a common source, Henry F. Bitner.
