The appellant was convicted under section 2098, General Statutes of 1901, upon an information charging that he did, on the 23d day of May, 1903, in the county of Cherokee, state of Kansas, unlawfully, feloniously and wilfully break and injure passenger-car No. 31 on the Southwest Missouri Electric Railway Company’s tracks, by throwing a stone against, and breaking the glass in, a window of said car.
