ORDER DENYING PARTIAL SUMMARY JUDGMENT

SCHREIER, District Judge.

Plaintiff, Jason Chien, on behalf of himself and his minor daughter Angela, filed a complaint against the City of Sioux Falls, David Osterquist, and James Larson, alleging multiple causes of action against all defendants, including false imprisonment and malicious prosecution, negligence, assault, and deceit arising from an automobile accident. Defendants deny the allegations and move for partial summary judgment on all claims except the negligence claim.
