MOTION for a receiver, in supplemental proceedings, heard before Graves, Judge, at Chambers in RowAN county. His Honor refused the motion, and the plaintiff appealed.

The plaintiff obtained judgment at Spring Term of 1874, of the Superior Court .of Rowan county, against the defendant for the sum of $31,187.17 and costs. The defendant then, and ever since that time, has .resided, in the county of Mecklenburg. The judgment mentioned was docketed in the Superior Court of the latter county, on the 9th day of September, 1874. Executions against the property of the defendant, repeatedly issued upon this judgment from the Superior Court of Rowan county, directed and delivered to the sheriff of Mecklen-burg county, and the last one was so issued and delivered on…
