LEIBELL, District Judge.
This is an action by employees of defendant to recover unpaid overtime compensation and liquidated damages, under Section 16(b) of the Fair Labor Standards Act, 29 U.S.C.A. § 216(b).
The defendant has moved “ * * * for an order dismissing the complaint in the within action upon grounds set forth in Rule 12 of the Rules of Civil Procedure for the District Courts of the United States as follows: 1.
