This action involves a challenge by the plaintiff State of Alabama (“the State”) to certain regulations (“the Regulations”) promulgated by the defendant Secretary of the Department of the Interior (“the Secretary”) addressing Indian gaming under the Indian Gaming Regulatory Act (“IGRA”). The other defendants include the United States of America and the United States Department of the Interior (collectively, “the federal defendants”), as well as intervenor-defendant Poarch Band of Creek Indians (“the Tribe”).
