The plaintiff in error, Elijah Brown, hereinafter called defendant, was convicted of rape and sentenced to a term of 50 years in the penitentiary. The facts in the case are as follows:
On the 8th day of July, 1925, a complaint was filed before the county judge of Cotton county, charging the defendant in two counts, the first count charging rape in the first degree, and the second count charging incest, a warrant was issued, and defendant was arrested and placed in the county jail.
