Sensor Systems Support, Inc. (“Sensor Systems”) filed an amended complaint on October 3, 2011, seeking to compel the Federal Aviation Administration (“FAA”) to produce records in response to its request under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552. The FAA filed a motion to dismiss for lack of subject matter jurisdiction or in the alternative for summary judgment.
