This appeal challenges the district court’s dismissal of a habeas corpus petition for failure to exhaust available state remedies. The question presented is whether the petitioner’s writ for habeas corpus is appropriate only under 28 U.S.C. § 2254 or whether it also may be brought under 28 U.S.C. § 2241. 1
