MEMORANDUM OPINION

OSTEEN, District Judge.

Plaintiff Christopher Douglas Wagstaff (“Wagstaff’) brought this action against his employer, the City of Durham (“the City”), in Durham County Superior Court, on May 23, 2001. Plaintiff alleges that by selecting someone else for a position in the Durham Police Department, the City engaged in racial discrimination in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e, et seq.
