In an indictment returned by the grand jury of the county of Riverside the defendant was charged in three counts with the crime of murder. A fourth count, charging an entirely different offense, was dismissed upon motion of the district attorney. Upon his arraignment the defendant entered a plea of not guilty to each of the murder counts. After a prolonged trial he was found guilty as charged, and, the jury having failed to make any recommendation as to punishment, he was sentenced to suffer the extreme penalty.
