Ritz, Judge:

This suit was instituted for the purpose of having sale of a tract of 905 acres of land for the benefit of the school, fund. There are two sets of claimants to this land,, to-wit,. the Central Pocahontas Coal Company, claiming it under a, deed from John V. Bouvier and others; and A. D. Preston, and others, claiming it under a title derived from the commissioner of school lands of Wyoming county. This tract of 905 acres is a part of a larger grant of 480,000 acres made by the Commonwealth of Virginia in the year 1795 to Robert Morris. This 480,000-aere grant, together with another…
