This matter comes before the Court on a Motion to Suppress brought by Defendant Jason Richard Allison (Defendant), which the Government resists. The Court held an evidentiary hearing on the motion on April 24, 2009. Assistant United States Attorney Emily Nydle represented the Government. Attorney James Whalen represented Defendant. After the hearing, the Court requested further briefing in light of Arizona v. Gant, - U.S.-, 129 S.Ct. 1710, 173 L.Edüd 485 (2009). The supplemental briefing is now complete.
