While plaintiff/appellant Christine Franklin was a student at North Gwinnett High School, she was allegedly subjected to sexual molestation and/or abuse by a former teacher at the school, Andrew Hill. Plaintiff filed suit on December 29, 1988, against the Gwinnett County Public Schools and Dr. William Prescott, the band director at North Gwinnett High School, in the United States District Court for the Northern District of Georgia (hereinafter the “federal court action”).
