This case is again before us [its first appearance is reported in 409 So.2d 298 (La.App. 3rd Cir.1981), writ denied 411 So.2d 464 (La.1982) ], this time as an appeal from the dismissal of an action of nullity. The action of nullity sought to annul the judgment of the Ninth Judicial District Court rendered and signed in the captioned case on October 13, 1980, and later affirmed by this court in the decision cited above.
