This case involves a-construction of certain provisions of the Act of Congress, commonly called the War Risk Insurance Act, of 1917 (40 Stat, 398), and amendments thereto, and the statutes of distribution of intestate’s estates contained in our law.

In 1917, James W. Carter, colored, intermarried with Daisy McNeal. At the time the said Daisy had three illegiti mate children,, namely, Adam McNeal, Lizzie McNeal, and Peter McNeal, and it is not contended that James. W. Carter was the father of any of said children. Peter was about 2…
