Proceeding pro se, Kenneth Baker (“Baker” or “Petitioner”) has filed a petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254 challenging his state custody pursuant to a judgment of conviction following a jury trial in New York State Supreme Court (Monroe County) on charges of murder in the second degree (New York Penal Law (“P.L.”) § 125.25(2)) and assault in the first degree (P.L. § 120.10(1)).
