This action was brought to recover damages for injuries received by the infant plaintiff through the negligence of the defendant. It came on for trial before the court and jury and resulted in a verdict "in favor of the *556plaintiff in the sum of $120. On the rendition of the verdict the defendant immediately moved to set it aside on the grounds first, that the jury disregarded the court’s instructions ; second, that the verdict was against the weight of evidence, and third, for a new trial on all the grounds specified in section 999 of the Code of Civil Procedure.
