This is an action brought by the American Surety Company of New York, a corporation, appellant in No. 5277, and appellee in No. 5294, hereinafter referred to as the plaintiff, against the Carbon Timber Company and others, appellee in the first number above referred to and appellants in the latter, hereinafter referred to as defendants.
