In this case, the defendant, 25-30 120th Street Queens Corp., was the owner of a certain tract of land which it had purchased from the City of New York in 1966 and which was located under the waters of Flushing Bay. The land was the size of an entire city block between partially paved upland 120th Street to the east and the bed of the mapped but unopened 119th Street which lay underwater to the west.
