Hatch, J.:
This action was commenced against John Groh, and an answer was interposed by him. He died before the case came on for trial, his executrix was substituted as defendant, and an amended answer was served by her.
The plaintiff is a domestic corporation. Three separate causes of action are alleged in the complaint. In the first cause of action it is averred that M. Groh’s Sons prior to December 30, 1896, was a copartnership; that the defendant’s testator, John Groh, had charge of its cash, and that between June 1, 1895, and December 30, 1896, .he received $7,175.02 belonging to said…
