RAMSEY, Judge.
Appellant was indicted in Fannin County, in August, 1903, for the murder of one E. J. Johnson. At a former trial he was convicted of manslaughter, which conviction was subsequently set aside and in March of this year he was again put on trial in the District Court of Fannin County, and was again convicted of manslaughter and Ms punishment fixed at- confinement in the penitentiary for a period of five years.
