LANE, Special Judge.
This case, on change of venue, was tried in the District Court of Wichita County, and appellant was convicted of murder in the second degree; penalty, twenty years confinement in the penitentiary. This is the third appeal. The first appeal will be found in the 45 Texas Crim. Rep., 297, and the second in the 51 Texas Crim. Rep., 230. In the opinion on the first appeal, we think, will be found a sufficient statement of the case.
