Clarke, J. :

This is an appeal from & decree of the Surrogate’s Court admitting to probate two instruments, executed in the city of Paris, France, in accordance with the forms required by the laws of the State of Hew York for the execution of testamentary instruments,* as the last will and testament and codicil of Charles Rubens. The decedent described himself in the instrument as “ a citizen of the United States of America now residing at Number 41 Avemie de 1’Alma in the City of Paris, France.” It is conceded that Mr. Rubens died in Paris, and that he had lived in said city for many years…
