The questions presented for determination arise upon the return of an order to show cause to dismiss the proceeding for the probate of the alleged last will and testament of a non-resident decedent.

He died at Montclair, New Jersey, on October 18, 1937. It is undisputed that he was a resident of that State. It is alleged in the petition of the proponent that the decedent left tangible and intangible personal property in New York county.
