ORDER
FOREMAN, Chief Judge.
Before the Court is defendant Trans-Cold Express, Inc.’s Motion for Summary Judg ment. Plaintiff brings this action to recover damages for injuries he sustained as a passenger in a tractor leased to defendant Trans-Cold Express, Inc. The Court has jurisdiction to hear this matter pursuant to 28 U.S.C. § 1332. 1 In the Court’s opinion, no material fact is in dispute and defendant Trans-Cold Express, Inc. (hereinafter defendant Trans-Cold) is entitled to judgment as a matter of law.
