This was an action for damages against defendants for wrongfully depriving plaintiff of his property rights and interest in a mercantile establishment which had been the subject of a curious bargain between the litigants.

In 1921 and for some time prior thereto, the plaintiff, C. N. Fowler, was the proprietor of a large mercantile business in Hutchinson, which he conducted through a manager named John Dinwiddie. Fowler himself resided in Salina and had a position with certain fraternal…
