Appeal from municipal court. Action by Arthur E. Strong, by his guardian ad. litem, against Oliver A. Jenkins and Andrew J. Kurtz. The court granted a nonsuit as to defendant Kurtz, and rendered judgment against defendant Jenkins, who appeals.

This action was commenced in the municipal court by the plaintiff against Oliver A. Jenkins and Andrew J. Kurtz for unlawfully taking money belonging to the plaintiff. It appears from the undisputed testimony 0 that the plaintiff was the owner of certain household furniture in the hotel formerly known as the “Huron House.” That one James Willis had a chattel mortgage on a portion of the furniture, and before the commencement of this action assigned his interest in the claim against the defendant to the plaintiff.
