Plaintiff’s declaration sets forth in separate counts two causes of action. He sought to recover money paid by him to defendant in the purchase of two separate and distinct lots of stock, the sales of which were alleged! to be in violation of section 11945 et seq., 3 Comp. Laws 1915, commonly called the blue sky law. At the conclusion of the proof, both parties moved for a directed verdict. Decision was reserved and the issues submitted to the jury, with instructions to return a finding as to each of plaintiff’s claims. Their finding is thus stated in the record:
